A Released Palestinian Prisoner who murdered an American in Israel can be prosecuted Under US Anti-Terrorism Law” says Sarah Stern of the Washington, DC- based Endowment for Middle East Truth (EMET)

Israel released under cover of darkness 26 Palestinian and Israeli Arab Terrorists Tuesday night August 13, 2013. 11 went to the Palestinian Authority in Ramallah, while 14 were sent to Gaza by Israeli Security. They were the first contingent of upwards of 104 prisoners held by Israel to be released in stages as a so-called confidence building step for the current round of peace discussion between Israel and the Palestinian Authority facilitated by Secretary of State John Kerry.

One of those released was Aj Haj Othman Amar Mustafa, who with, Damara Ibrahim Mustafa Bilal killed Steven Frederick Rosenfeld, an American and former Marine in June 1989 while he was hiking in the Judean Hills.  Rosenfeld’s Israeli wife and brother survive him.

Sarah Stern, founding President of EMET in an interview with Jerry Gordon, Senior editor of the, New English Review, said that both Aj Haj Othman Amar Mustafa and Damara Ibrahim Mustafa Bilal could be prosecuted in the US for Rosenfeld’s murder in the US under provisions of the 1990 Federal Anti-Terrorism Law.  She further said that the US Department of Justice under the 1990 Federal Anti-Terrorism Law could issue an Interpol red tag warrant and pursue his extradition via treaties the US has with Israel and Jordan.

Stern also suggested that a previously released Palestinian terrorist,  Ahlam Tamimi, could also be brought to justice in the US.  She is now a resident in Jordan who conducted reconnaissance, arranged for transport, and guided the suicide bomber to his target in the August 2001 Sbarro Pizza attack that killed two Americans 15-year old Malki Roth and 28-year old expectant mother Judith Greenbaum. 15 people in total were killed, 130 injured.

EMET supports a letter by Arizona Representative Matt Salmon (R-5th CD) to US Attorney General Eric Holder urging him to pursue prosecution of Rosenfeld’s murderer under the provisions of the 1990 Federal Anti-terrorism law via Office of Justice for Victims of Overseas Terrorism (OJVOT) in the US Department of Justice. The OJVOT was formed in response to the passage of the Koby Mandell Act.

Stern said that there are other prospective Palestinian prisoners scheduled for release who have undertaken attacks against Americans who might be subject to prosecution under the Federal 1990 Anti-Terrorism law.
